HIPAA and Mental Health Privacy
As a covered entity under the Health Insurance Portability and Accountability Act (HIPAA), Pinnacle Behavioral Health & Wellness maintains strict protections for your Protected Health Information (PHI). Mental health records receive heightened privacy protections under both federal HIPAA regulations and North Carolina state law (N.C.G.S. § 122C-52 et seq.).
Your psychiatric records, treatment notes, diagnosis information, and medication history are protected health information (PHI). PHI is protected under HIPAA and applicable North Carolina state laws. We will not share your PHI without your explicit written consent, except as required by law. Permitted disclosures include mandatory reporting of child abuse or imminent threat of harm, treatment coordination with other providers (with your consent), and billing disclosures to insurance companies.
We will never sell your mental health information to third parties, use it for marketing purposes, or share it with employers, schools, or family members without your explicit written consent.
Telehealth Privacy Protections
All telepsychiatry appointments at Pinnacle Behavioral Health are conducted using a HIPAA-compliant video platform. This means the video connection is encrypted end-to-end and stored on secure servers that meet federal standards for protected health information. We do not record video appointments without your explicit written consent.
To protect your privacy during telepsychiatry appointments, we recommend attending from a private location where others cannot overhear your conversation, using a personal device rather than a shared or work device. Using a secure private internet connection rather than public Wi-Fi. Your provider will also confirm they are in a private location at the start of each appointment.
Your Privacy Rights
As a patient of Pinnacle Behavioral Health, you have the right to request access to your medical records, request corrections to inaccurate information in your records, request restrictions on how your information is used or disclosed, receive a full accounting of disclosures of your health information, and file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights if you believe your privacy rights have been violated.
To exercise any of these rights, contact us in writing at info@pinnaclebhw.com or by fax at 336-444-6144.
